Booking Terms & Conditions

These terms apply to direct bookings made with Neil Gallacher (owner-host) for La Casa Neil holiday apartment in Calahonda, Mijas, Málaga, Spain. Bookings made via Airbnb are governed by Airbnb's terms, not these.
This document is provided as plain-language guidance. It is not a substitute for legal advice; please review carefully before booking.
1. Making a booking
- An enquiry through the website is not a booking. It is an invitation for us to quote you a price for the dates you have requested.
- A booking becomes confirmed when (a) Neil confirms availability and price in writing (email or WhatsApp), and (b) the deposit (see below) has been received.
- The lead guest must be at least 18 years old.
2. Pricing and payment
- All prices are quoted in euros (€) and are inclusive of utilities for typical use during the booking period.
- A deposit of 25% of the total booking value is required to confirm the booking.
- The balance is due 28 days before check-in for bookings of 14 nights or fewer; for stays of 15+ nights, the balance is due 56 days before check-in.
- For last-minute bookings (less than 28 days before check-in), the full amount is payable at the time of booking.
- Payment methods: SEPA bank transfer, GBP bank transfer, or card-link via Stripe/Revolut (we will send you a payment link). We do not accept cash on arrival.
3. Damage deposit
- A refundable damage deposit of €300 is required for stays of 7+ nights. Held by bank transfer, returned within 14 days of departure subject to no damages.
- For longer stays (28+ nights), the deposit is €500.
- Reasonable wear and tear is not deducted from the deposit. Significant damage, missing items, deep cleaning beyond normal end-of-stay, and any costs of repair are deductible.
4. Cancellation policy
- More than 60 days before check-in: full refund minus a €30 administrative fee.
- 30–60 days before check-in: deposit (25%) is non-refundable; balance refundable.
- Less than 30 days before check-in: 50% of total booking is non-refundable.
- Less than 7 days before check-in or no-show: full booking value is non-refundable.
- Force majeure (government travel bans, airport closures preventing your arrival): we will work with you to reschedule to an equivalent stay within 12 months. No cash refund obligation but no penalty for rescheduling.
We strongly recommend purchasing travel insurance that covers cancellation.
5. Check-in and check-out
- Check-in: from 16:00 on the day of arrival. Self check-in via key safe; the code is shared on the morning of arrival.
- Check-out: by 11:00 on the day of departure. Late check-out can be arranged if there is no immediate following booking — please ask.
- Lost keys: replacement cost €50.
6. House rules
- Maximum occupancy: 4 people. Children and infants count toward the total. Visitors are welcome by day but additional people may not stay overnight without prior agreement.
- No smoking indoors. Smoking on the terrace is permitted.
- Pets are not permitted (small, well-behaved dogs may be considered on request — please ask before booking).
- Parties and events are not permitted.
- Quiet hours: 23:00–08:00 (community rules).
7. Our responsibilities
- We will provide the apartment as described and photographed, clean and ready for your stay.
- If something breaks during your stay, please report it and we will repair or replace it as quickly as possible.
- We are not responsible for personal belongings lost or stolen during your stay. Please use the safe-deposit box for valuables.
- Force-majeure events (extended power cuts, water-supply failures, extreme weather) that materially affect your stay will be handled in good faith — we will offer a partial refund or rescheduling proportional to the disruption.
8. Communal facilities
The apartment is part of the La Cornisa community. Communal pools, gardens and amenities are governed by the community rules, which take precedence over these terms in respect of communal areas. Pool opening dates vary slightly year to year (typically 1 May – 30 September). Pool closures for maintenance or weather are not grounds for refund.
9. Governing law
These terms are governed by Spanish law. Any dispute will be resolved in the courts of Málaga, Spain.
